To Whom It May Concern(parts II & III)

According to the definitions section of the District of Columbia's Municipal Regulations, a "motorized bicycle" is such:

(1.) under 50cc engine displacement
(2.) 1.5 horsepower breaking power or less
(3.) wheels larger than 16 inches
(4.) a maximum speed of 35 mph or less

My 2007 Tomos Streetmate meets these specifications, and is registered and titled as a motorized bicycle in the District of Columbia. It carries the tag #******.

Chapter 12 of the District of Columbia Municipal Regulations is entitled "Bicycles, Motorized Bicycles, and Miscellaneous." Section 1209 is entitled "Parking Bicyles on Public Space." District of Columbia Municipal Regulation 1209.7 of this chapter and section reads:

1209.7 All provisions of this section shall be equally applicable to the parking or securing of motorized bicycles.

For months I have parked my motorized bicycle adjacent to my office on 17th Street, NW, in accordance with the District of Columbia Municipal Regulations 1209.1-1209.7. I secure my motorized bicycle to a permissible stanchion(streetlight) by use of a lock in such a manner as to afford no obstruction of pedestrian traffic.

On both Wednesday, April 23, 2008 and Tuesday April 29, 2008 I received parking citations from Officer T. Neal, Department 15, Badge #00124, both for the violation P047 MOTORCYC SIDEWALK, ON.

Each citation carries a fine of $100.

At the time of each infraction, my motorized bicycle was secured to a permissible stanchion(streetlight) by use of a lock in such a manner as to afford no obstruction of pedestrian traffic, in accordance with the District of Columbia Municipal Regulations 1209.1-1209.7.

Please find attached citations 379287171 & 379285266, a copy of my District of Columbia Department of Motor Vehicles Registration Certificate for Tomos 2007 motorized bicycle, a photo of the motorized bicycle just after "infractions."

Thank you for your prompt attention to this matter,

Is the District just trying to earn money?? or are they bored? I feel like there are bigger problems than a bike chained to street lamp.

It's not just bikes. It's everything. From no more non-emergency police number, to forcing meters on the hardworking taxicab drivers that live and work in the district for the benefit of confused tourists, the "answer to no one" approach of the Fenty administration is hacking away all the wonderful quality of life improvements Mayor Williams brought to DC's residents.
Sad? Yes. Shocking? Yes. Surprising? No.

Ha! Just got my adjudication letter back from the Officer Carter incident. He never turned the tickets in. He was, as suspected, just being a dick.
